1. Welcome to African Lux Safaris

Thank you for choosing CURAH Africa Luxury Safaris for your adventure. We specialize in creating personalized luxury safari experiences and are committed to delivering an exceptional journey across Africa’s breathtaking landscapes.

These Terms and Conditions (“Agreement”) govern your use of our website and services, including safari bookings, travel planning, accommodations, transportation, and activities (collectively, “services”). By booking a safari (“travel program”) with us, you acknowledge that you have read, understood, and agreed to abide by this Agreement, as well as any additional terms provided by CURAH Africa Luxury Safaris and its third-party service providers, including lodges, airlines, and tour operators.

Please review these terms carefully, as they define your rights, responsibilities, and obligations when engaging with CURAH Africa Luxury Safaris.

2. Business Identity

CURAH Africa Luxury Safaris operates under African Luxury Safaris & Expeditions LLC, a legally registered entity in the United States. We conduct business under the following trade names (DBAs): CURAH Africa, CURAH Africa Luxury Safaris, CURAH Travel, CURAH Luxury Travel, CURAH Safaris & African Lux Safaris.

All transactions, agreements, and liabilities related to bookings are exclusively between the traveler and African Luxury Safaris & Expeditions LLC, regardless of the branding used in marketing, communications, or promotional materials. 

For the purposes of this Agreement, references to “CURAH Africa Luxury Safaris,” “we,” “us,” or “our” shall mean African Luxury Safaris & Expeditions LLC and its associated DBAs. The terms “you” or “the traveler” refer to the individual booking a reservation or engaging with our services. These Terms and Conditions apply to all safari and travel programs booked through CURAH Africa Luxury Safaris.

3. Booking and Payment Terms

Booking your safari with CURAH Africa Luxury Safaris begins by contacting us directly or through your Travel Advisor. Our team will work closely with you to craft a personalized itinerary tailored to your preferences. To secure your reservation, a non-refundable deposit is required. This deposit confirms your booking and holds your place on the tour.

Payment Policies:

  • A deposit of 30% or more is required to confirm your safari package. Certain components of your itinerary may require a higher deposit based on individual supplier terms.
  • The remaining balance is due in full 90 days prior to departure.
  • For bookings made within 90 days of departure, full payment is required at the time of confirmation.
  • We accept payments via Visa, MasterCard, Discover, American Express, as well as cash, check, and ACH/wire transfers.
  • Your payment—whether by credit card, bank transfer, check, or other accepted method—constitutes a binding agreement to the terms and conditions outlined in this document.

 

Failure to Pay & Automatic Cancellation:

  • If full payment is not received by the due date, your reservation will be automatically canceled, and cancellation fees will apply as outlined in Section 18 (Refund and Cancellation Policy).
  • No refunds will be issued for cancellations due to non-payment, and CURAH Africa Luxury Safaris is not responsible for any resulting losses or costs.

 

Additional Payment Conditions:

  • Prices are listed in U.S. Dollars (USD).
  • If a payment is declined, reversed, or disputed, the booking will be considered unconfirmed until resolved, and cancellation penalties may apply.
  • Refunds are only processed according to the policies stated herein, and disputes are limited to cases of fraud.
  • CURAH Africa Luxury Safaris reserves the right to deny service or cancel reservations for travelers who fail to meet payment obligations.

 

Trust Account & Consumer Protection  

  • In compliance with California law, CURAH Africa Luxury Safaris maintains a business trust account. All client funds received for travel services are deposited into this account and disbursed only for the purposes of fulfilling travel services or issuing applicable refunds.
  • Note on Credit Card Payments: For airfare booked through third-party suppliers where the traveler pays the supplier directly, CURAH Africa Luxury Safaris is exempt from depositing these funds into a trust account under Section 17550.15(j)(1) of the California Business and Professions Code.
4. Pricing and Rates

CURAH Africa Luxury Safaris strives to provide transparent pricing; however, certain external factors may impact final costs.

Pricing Terms:

  • All prices listed are for land-only arrangements and do not include international airfare unless explicitly stated.
  • Prices are subject to change without notice due to exchange rate fluctuations, supplier pricing adjustments, increased fuel costs, park fees, and government-imposed charges.
  • Once a deposit is received, the land price is guaranteed; however, additional surcharges may apply for fuel increases, conservation fees, or regulatory changes beyond our control.
  • CURAH Africa Luxury Safaris reserves the right to correct any pricing errors before final payment is made.
  • Private tour rates are based on a minimum of two guests. Solo travelers will incur a single supplement fee due to accommodation pricing structures. If a travel companion cancels, the remaining traveler is responsible for any applicable single supplement fees.

 

Airfare & Airline Charges:

  • CURAH Africa Luxury Safaris may assist with international airfare at an additional cost. However, all baggage fees, seat selection fees, and other airline-imposed charges are the sole responsibility of the traveler and are subject to the airline’s terms and conditions.
  • Travelers are responsible for reviewing their airline’s baggage policies, visa requirements, and check-in procedures before departure.
5. Guest Information

To ensure accurate booking and compliance with travel regulations, travelers must provide correct and complete personal information at the time of reservation.

Guest Information Requirements:

  • The traveler’s name must match their passport exactly. Any discrepancies may result in denied boarding, immigration issues, or additional fees for corrections.
  • Travelers must provide full passport details and dates of birth for all individuals included in the booking.
  • Errors or omissions in the information provided that require corrections may result in additional fees, and in some cases, new tickets may need to be purchased at the traveler’s expense.

 

Additional Passport & Documentation Requirements:

  • Passports must be valid for at least six (6) months beyond the travel return date.
  • Travelers must ensure they meet all visa, entry, and vaccination requirements for their destination.
  • CURAH Africa Luxury Safaris is not responsible for denied entry, airline refusal, or travel disruptions resulting from inaccurate personal information, expired passports, or missing documentation.
6. Travel Insurance

CURAH Africa Luxury Safaris strongly recommends that all travelers purchase comprehensive travel insurance to protect against trip cancellations, medical emergencies, evacuations, lost baggage, and other unexpected travel disruptions.

Minimum Recommended Coverage:

  • Medical, evacuation, and repatriation coverage of at least $200,000 USD.
  • Coverage must extend for the entire duration of travel, including activities booked through third-party operators.
  • Some countries require travelers to provide proof of valid medical insurance before entry. Travelers who fail to meet these requirements assume full responsibility for denied entry or travel disruptions.

Waiver for Travelers Declining Insurance:

  • If you choose to decline travel insurance, you must sign a waiver acknowledging that you assume full financial responsibility for any trip cancellations, medical emergencies, evacuations, or financial losses incurred.
  • CURAH Africa Luxury Safaris will not be liable for any expenses that could have been covered by insurance.
  • CURAH Africa Luxury Safaris is not responsible for verifying the quality or existence of your insurance coverage. Travelers are solely responsible for ensuring that their policy meets their needs.
  • Without trip cancellation insurance, travelers are subject to the cancellation fees outlined in Section 18 of these Terms and Conditions.


By booking a safari, you confirm that you understand the risks of traveling without insurance and accept full responsibility for any financial losses that arise.

7. Health and Safety

Traveling to certain parts of the world involves risks, and it is the traveler’s responsibility to be fully prepared for all health-related requirements. We strongly encourage travelers to consult with health professionals regarding recommended vaccinations, medications, and health precautions before their trip. Travelers must comply with any health requirements or advisories related to the regions they are visiting.

Traveler Fitness & Medical Disclosure:

  • By booking a safari, you certify that you are physically fit to participate in all activities included in your itinerary.
  • Travelers with pre-existing medical conditions, mobility limitations, or other health concerns must disclose their condition prior to booking to determine if special accommodations are required.
  • It is the traveler’s responsibility to carry all necessary medications and medical supplies for the duration of their trip.


Medical Risks & Emergency Considerations:

  • Certain remote safari destinations lack immediate access to medical facilities, and emergency evacuation may be required at the traveler’s expense.
  • CURAH Africa Luxury Safaris does not provide medical advice or assume responsibility for medical complications that arise before, during, or after travel.
  • We strongly recommend that all travelers purchase comprehensive travel insurance, including coverage for medical emergencies and evacuation.


Traveler Assumption of Risk & Liability:

  • Travelers acknowledge and accept all health risks associated with travel, including but not limited to exposure to tropical diseases, limited medical infrastructure, and physical demands of safari activities.
  • CURAH Africa Luxury Safaris is not liable for any injuries, illnesses, pre-existing medical conditions, or health-related issues that occur before, during, or after travel.


Failure to disclose pre-existing medical conditions may result in denial of participation in certain activities or cancellation without a refund.

8. Visa and Passport Requirements

It is your responsibility to ensure that your passport is valid for at least six months after your return date and to obtain any necessary visas. We are not responsible for delays or issues related to visa processing. For up-to-date visa requirements, visit the U.S. Department of State website.

Valid passports are required for travel to most destinations. Check with the appropriate consulate or embassy for the latest visa requirements. It is your responsibility to obtain all necessary documentation for travel, including but not limited to passports, required visas, reciprocity fees, affidavits, immunizations, and vaccinations for entry, departure, and travel to each country or region included in your travel program. CURAH Africa Luxury Safaris does not provide advice on travel documents and makes no representations or warranties regarding the accuracy or completeness of information provided on visas, vaccinations, climate, clothing, baggage, or special equipment. You agree that CURAH Africa Luxury Safaris is not responsible for any errors or omissions in this information.

9. Flights and Transfers

It is your responsibility to confirm flight details directly with the airline before departure. If you have arranged your own flights, please provide us with your flight information at least 30 days before departure to ensure transfer arrangements are made. Any changes to your flight plans should be communicated to us immediately.

10. Accommodation and Facilities

Accommodation standards and facilities may vary by region and may not match those in the United States. We reserve the right to substitute similar hotels if necessary. Room sizes, amenities, and accessibility may differ, and no refunds will be given for such variations.

11. Sightseeing and Optional Activities

Sightseeing tours are included as per the itinerary. Please be punctual, as tours will depart on time. Optional activities offered by third-party suppliers are subject to their terms and conditions, and any disputes should be directed to the supplier.

12. On-Tour Policies

Smoking is not permitted on any transportation or within indoor or outdoor facilities, subject to local laws. Any physical limitations or special requirements must be communicated to us at the time of booking. While we will make reasonable efforts to accommodate special needs, guests are responsible for their own safety and well-being.

13. Changes to Itineraries

We strive to operate all tours as planned, but circumstances may require modifications to the itinerary, accommodations, or transportation. Any such changes will be made with the intent of maintaining the quality and enjoyment of your trip. These changes are not grounds for cancellation or refunds.

We reserve the right to make changes to the safari itinerary as necessary, including but not limited to changes due to weather conditions, wildlife movements, and safety concerns. Any changes will be communicated to travelers as soon as possible.

All prices comprising your travel program are based on current rates of exchange, tariffs, and taxes. CURAH Africa Luxury Safaris reserves the right to increase the price of your travel program in the event of:

  • Increased costs from suppliers associated with your travel program,
  • Tariffs and taxes, and
  • Fluctuations in foreign exchange markets.

 

CURAH Africa Luxury Safaris also reserves the right to withdraw a tour or any part of it, make alterations to the itinerary or tour inclusions as it deems necessary or desirable, and pass on to tour members any expenditures or losses caused by delays or events beyond its control. Itineraries and arranged sightseeing tours are subject to change at any time due to unforeseen circumstances or circumstances beyond CURAH Africa Luxury Safaris’ control. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued.

If you request a change to your travel component, you acknowledge and agree that any such requested changes may incur additional fees charged to you by CURAH Africa Luxury Safaris.

14. Baggage

Weight restrictions may apply on internal and domestic flights. Baggage and personal effects are at the owner’s risk throughout the travel program. It is your responsibility to check with the airline for baggage restrictions applicable to international and domestic flights.

15. Air Transportation

CURAH Africa Luxury Safaris will not accept any responsibility for mistakes or errors in airfare bookings made by you or independent third parties. The traveler’s confirmations will have detailed tour information, and it is up to the traveler to ensure the correct arrival and departure flight information from the tour start and end cities. If your program includes our services through an independent agent, they will arrange the best-priced airfare available in the class category you request at the time of your booking. Please note that certain airfares are subject to a service fee. Should you cancel or change your air reservation before or after your departure, cancellation penalties may apply.

Airlines concerned are not to be held responsible for any act, omission, or event during the time passengers are not aboard their aircraft or conveyance. CURAH Africa Luxury Safaris is not responsible for changes in airline itineraries or flight times and does not guarantee seat assignments or meal preferences. These are at the discretion of the airline and are subject to availability. Any airline-imposed fees for baggage, changes, seat assignments, or other services are your responsibility.

If your travel program includes flights provided by an independent supplier, the terms and conditions of the airline or operator will apply. CURAH Africa Luxury Safaris is not liable for any delays, cancellations, or interruptions to air travel and will not refund or credit you for these occurrences. In the event of a missed connection or any other issue arising with your flights, it is your responsibility to liaise directly with the airline to resolve the matter.

16. Force Majeure

CURAH Africa Luxury Safaris shall not be liable for any failure or delay in fulfilling its obligations when such failure or delay results from circumstances beyond its reasonable control (“Force Majeure”). These circumstances include, but are not limited to:

  • Natural disasters (earthquakes, floods, wildfires, pandemics).
  • Acts of war, terrorism, civil unrest, or government-imposed travel restrictions.
  • Airline strikes, flight cancellations, or schedule disruptions.
  • Extreme weather conditions affecting travel safety.
  • Government actions, embargoes, or changes in law that impact travel.
  • Health emergencies, including widespread disease outbreaks.


In the event of a Force Majeure event, CURAH Africa Luxury Safaris will make reasonable efforts to reschedule the safari or provide a future travel credit. Any refunds, if applicable, will be subject to the refund policies of third-party suppliers, including lodges, airlines, and tour operators.

CURAH Africa Luxury Safaris does not guarantee full or partial refunds in Force Majeure situations and is not responsible for additional costs incurred as a result of delays, cancellations, or rescheduling. Travelers are strongly advised to purchase comprehensive travel insurance to cover unforeseen disruptions.

17. Limitation of Liability

Your participation in any CURAH Africa Luxury Safaris travel program is at your own risk. CURAH Africa Luxury Safaris, its employees, directors, agents, and affiliates (collectively, “CURAH Africa Luxury Safaris”) shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of, inability to use, or participation in any of the services provided, even if CURAH Africa Luxury Safaris has been advised of the possibility of such damages.

CURAH Africa Luxury Safaris is not responsible for any injuries, damages, losses, or claims arising from activities that involve inherent risks, including but not limited to:

  • Wildlife encounters, including interactions with dangerous animals.
  • Walking safaris, hot air balloon excursions, off-road game drives, and other adventure activities.
  • Water-based activities such as boat safaris, canoeing, snorkeling, or diving.
  • Physical injuries, illness, or death resulting from extreme weather, natural terrain, or environmental conditions.
  • Acts, omissions, or negligence of third-party providers, including but not limited to lodges, airlines, transportation providers, and independent tour operators.
  • Delays, cancellations, or interruptions due to government actions, civil unrest, natural disasters, or force majeure events.


CURAH Africa Luxury Safaris does not own, control, or operate any accommodations, airlines, restaurants, transportation providers, or third-party tour operators. As such, CURAH Africa Luxury Safaris cannot be held liable for any negligence, errors, or breaches of contract committed by third-party suppliers. Any claims regarding third-party service failures must be directed to the supplier responsible.

Indemnification:

You agree to indemnify and hold CURAH Africa Luxury Safaris harmless from and against any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising from or related to:

  • Your use of CURAH Africa Luxury Safaris’ services.
  • Your breach of this Agreement.
  • Your violation of any rights of a third party.


Liability Cap:

Our total liability, whether in contract, tort (including negligence), or otherwise, shall not exceed the total amount paid by the traveler for the safari program. Under no circumstances shall CURAH Africa Luxury Safaris be liable for indirect, consequential, or punitive damages, including lost profits, emotional distress, or pain and suffering.

18. Refund and Cancellation Policy

If you need to cancel your safari, you must notify us in writing. The effective date of the cancellation will be the date we receive your written request.

Cancellation Fees:

  • More than 90 days before departure: Loss of 30% deposit.
  • 90 – 61 days before departure: 50% of total safari cost.
  • 60 days or less before departure: 100% of total safari cost (non-refundable).

 

Refund Processing:

  • Refunds, if applicable, will be processed within 30-60 days of the cancellation request. However, refund processing times may vary depending on third-party suppliers, and CURAH Africa Luxury Safaris is not responsible for delays caused by airlines, lodges, or other service providers.
  • Refunds are subject to third-party supplier policies and may exclude non-refundable deposits, administrative fees, and penalties imposed by lodges, airlines, and other service providers.

 

Please note that certain services, such as internal flights or special accommodation arrangements, may be non-refundable regardless of the cancellation date. We highly recommend purchasing travel insurance to protect against unforeseen cancellations.

19. Amendments and Changes to Bookings

Travelers may request changes to their booking; however, amendments to bookings are subject to availability and third-party supplier policies. CURAH Africa Luxury Safaris will make reasonable efforts to accommodate change requests but cannot guarantee modifications after booking.

Change Fees:

  • Changes requested more than 60 days before departure: Subject to availability and supplier approval. Additional fees may apply.
  • Changes requested within 60 days of departure: Limited availability. Significant supplier penalties may apply.
20. Photography and Marketing

During your safari, CURAH Africa Luxury Safaris may take photographs or videos of guests for marketing purposes. By participating in a CURAH Africa Luxury Safaris tour, you grant us permission to use these images for promotional materials, social media, and advertising without compensation.

Opt-Out Process:

If you do not wish to be photographed or recorded, please inform us in writing before departure or notify our team upon arrival.

21. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the State of California, United States of America. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of California. You agree to submit to the personal jurisdiction of such courts and waive any objections to venue.

22. Consumer Risk Acknowledgment (Applicable for Certain International Suppliers)

In cases where travel services are provided by a business entity located outside the United States that is not registered under California’s Seller of Travel Program, the traveler will be asked to sign a Consumer Risk Acknowledgment and Disclosure Statement. This document affirms the traveler’s understanding that:

  • The supplier is not subject to California’s consumer protection laws;
  • The transaction is not covered by the Travel Consumer Restitution Fund (TCRF);
  • The traveler assumes all risks associated with these services;
  • CURAH Africa Luxury Safaris acts solely as an intermediary for those services.
23. TCRC Participation & Consumer Rights

CURAH Africa Luxury Safaris is a registered participant in the Travel Consumer Restitution Corporation (TCRC). California residents who book and pay through CURAH Africa Luxury Safaris may be eligible to file a claim with the TCRC in the event of non-delivery of travel services due to insolvency or seller default. This fund is a consumer protection measure under California Business and Professions Code Section 17550.38. Further information and claim forms are available at www.tcrcinfo.org.

24. Severability

If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.

25. Entire Agreement

This Agreement constitutes the entire agreement between you and CURAH Africa Luxury Safaris with respect to the subject matter herein and supersedes any prior agreements, representations, or understandings, whether written or oral, relating to your safari booking.
